Please read these Terms and Conditions carefully, as by submitting an order via this website you are agreeing to these terms and conditions, as well as the Legal Notice, and Privacy Policy Statements.

ORDERS AND QUOTATIONS

Because of the nature of computer monitors and printers, the colours of the Goods on the Website may differ from the colour of the Goods supplied to the Purchaser under the contract.

All information, including size, weight, specification, and delivery times, are approximate only, and any error in any quotation, or other document, may be corrected by Paean Books without liability.

SALE CONTRACT

Customers can place orders for goods displayed on this website by credit card payment through the PayPal system or alternatively by postal cheque or bankers draft. If cheque payment is preferred, then a Fully completed Order Form must be sent with payment to our offices, by post.

Paean Books will endeavour to dispatch all orders according to the Purchasers instructions in as timely a manner as possible, but reserves the right to await payment of funds from the Purchasers bank before dispatch. In all cases dispatch of Goods will comply to these Terms and Conditions of Sale.

Paean Books reserves the right to refuse orders where Customers are seeking to impose conditions on the Supplier over and above these Terms and Conditions, and will not accept orders where “Time is of the Essence.”

Paean Books will endeavour to acknowledge receipt of all orders by email, but shall not be liable for any failure on its part to reach the customer. No order acknowledgement will be made other than by email.

All delivery times are approximate, but Paean Books will attempt to deliver to addresses within Western Europe within 30 days of receipt and acknowledgement, of order. Failure to meet this 30-day guideline shall not invalidate the contract.

The price of the goods shall be as listed on this website, in English Pounds Sterling.

From time to time Paean Books may offer Special Offer Discounts to its customers. These offers are subject to change without notice.

The price of the Goods does not include postage and packaging, which will be charged in accordance with the stated rates and methods of dispatch.

Paean Books reserves the right to amend its delivery charges and delivery methods without notice, but will honour any orders placed prior to such a change, unless the change proves necessary as a result of circumstances beyond the Suppliers control, such as of a technical or fraudulent nature.

Paean Books may terminate any contract between itself and a Purchaser, if the Purchaser proves to be in breach of any of these Terms and Conditions, or if an administration, or bankruptcy order has been made against the Purchaser, or if the Purchaser has entered into any form of agreement with creditors.

Paean Books shall not be liable for the payment of any import duty, or levied tax, and it is the responsibility of the Purchaser to comply with the legislation of the Country to which the Goods are being sent.

Paean Books shall not be liable for any infringement of local laws caused by dispatch in accordance with the Customers instructions.

Except where stipulated in these Terms and Conditions, Paean Books excludes all warranties, terms and liabilities, to the fullest extent allowable by law, and will not be liable to the Purchaser for any consequential, or actual loss, whatsoever.

The Goods are not sold as being fit for any particular purpose, whether implied or expressed by the Customer, except for any statutory requirement under United Kingdom Statute and Common Law.

FAILED , WRONG, OR PARTIAL DELIVERY

In the event of non-availability of ALL Goods, Paean Books will credit the Customer in full.

If part of the Goods are not available, Paean Books will endeavour to contact the customer to seek instruction. If such communication cannot be made, then Paean Books will make an adjustment to the order value, and will reimburse the Customer for those parts of the order that could not be fulfilled. This adjustment shall include any adjustment to the rates for postage and packing.

If on delivery to the Customer, the goods do not include all the ordered items, or are incorrect, the Customer shall notify Paean Books within 7 Days, with their order reference. Subject to any dispatch investigation, Paean Books will in the event of short delivery, credit the Customer.

If the goods received are incorrect, then the Customer should return the goods to Paean Books, who will credit the Customer the cost of the goods and the Customers cost of postage and packing.

In the event of failed, or partial delivery, Paean Books liability shall be limited to the cost of the goods and the cost of the Customers postage and packing.

Ownership of, and title in the goods, passes to the Customer on delivery, or in the event of failed delivery, at the time that delivery was attempted.

If the Purchaser cancels the contract, or defaults in payment, they are obliged to return the Goods to Paean Books in saleable condition. Failure to return the goods within a reasonable period will leave Paean Books with no option but to seek redress by debt recovery, and the Purchaser will be liable for all costs incurred in recovering the debt.

RETURNS AND COOLING OFF PERIOD

For goods delivered to addresses within the European Union, a Customer may cancel the contract at any time up to 7 days after delivery of the goods, by notifying Paean Books by email, post, fax, or by hand.

If the goods have already been dispatched when notification of cancellation is received, the Customer shall return the goods to Paean Books at the Customers own cost, in suitable secure packaging.

Credit for cancelled goods will only be made after the goods have been safely received by Paean Books in saleable condition.

Any such credit (subject to clause 3.4.3.) will be made within 30 days of safe receipt of the goods (If goods have been dispatched), or within 30 days of receipt of notification of cancellation. (If goods have not been dispatched).

Paean Books will endeavour to deliver books free of defects and according to the Customers order, The Customer shall inspect the goods for manufacturing faults, and shall notify Paean Books within 7 days of delivery of any faults arising. Subject to inspection of the goods, Paean Books will replace the goods that it agrees are faulty, and will credit the Customer the cost of returning the items. Paean Books will only be liable for the cost of the Goods and postage and packing, and will in no circumstances accept liability for amounts exceeding that paid by the Purchaser to the Supplier.

GENERAL

Paean Books reserves the right to amend these terms and conditions at any time, but any such change will not affect orders placed prior to any changes. If such a change is deemed necessary, Paean Books will notify its customers by inserting a message and link on the homepage of this website. No other notification will be made, or deemed necessary.

All products are sold subject to the condition that they shall not be re-sold, loaned, hired out, or by any other means circulated, with any form of cover other than that with which they are published.

All prices are quoted in English Pounds Sterling.

The Suppliers rights shall not be affected by failure, or neglect on its part at any time to enforce any of these Terms and Conditions, nor affect the right of the Supplier to take remedial action.

If any of these Terms and Conditions are deemed by a United Kingdom Court to be invalid, this shall not affect any of the other Terms and Conditions.
